It is with interest that I note that ex-South Africans are now regarded as being SA citizens again, following the Consitutional Court verdict. This has some unintended negative consequences for people in this category. The most important is that you must now enter SA on a South African passport. This would not have been a big deal but, under normal circumstances, DHA states that it takes 12 months to obtain a SA passport. This means that any ex-SA citizen that is now suddenly a SA citizen again, cannot travel to SA for at least a year because, if you do, you'll be breaking the law and may be arrested. Was there not a smarter way of implimenting this? For example, why not provide an 18-24 month grace period for entering SA using your foreign passport without fear of breaking the law? During this period, an affected person could (a) either apply for a new passport or (b) formally renounce their SA citizenship (apparently this also takes 12 months to process).
