Dear Honourable Omphile Mankoba Confidence Maotwe
I hope this finds you well. I am writing to you as a last resort after over a decade of workplace exploitation, harassment and deliberatenon-compliance by the employer, the Department of Justice and Constitutional Development, specifically at Rustenburg Magistrate Court, North West Province. Despite numerous grievances, complaints and legal proceedings, the situation persists and I now humbly seek your intervention.
Overview of the Situation
For over almost a decade , I have been subjected to abuse, harassment and workplace exploitation. My grievances include:
1. Failure to address Disability Accommodation
Despite being diagnosed with a workplace related injury and occupational disease and providing all necessary documentation.
2. Non-compliance with Policies and Laws:
The employer has consistently ignored provisions of the Employment Equity Act (EEA), Section 13 of the Occupational Halth and Safety Act ( OHSA), and related regulations. This includes failing to educate employees about work hazards and proper use of Z1(a) form, leading to mishandling of my case.
3. Harassment and Retaliation
My efforts to address workplace abuse, including reporting corruption through forensic channels in Pretoria, have been met with retaliation. After my manager was charged following my whistle blowing efforts, my employer initiated false cases against me and subjected me to public humiliation and even physical assaults at work.
4. Delays and Obstruction of Justice:
I have lodged multiple cases with CCMA and GPSSBC, but employer has employed delaying tactics, refused to comply with agreed procedures, and sabotaged the resolution of my cases. Even a their second opinion report from the Employee Assistance Program (EAP) has been disregarded because it does not align with their agenda.
5. Health and Family Impact:
The relentless harassment and Non-compliance have taken a severe toll on my health. Leaving me permanently ill, and negatively affected my family. Despite being medically being booked off, my employer continues to harass me, further exacerbating my condition and costing me financially. Further I just discovered that all my leaves that I reported up until are not even captured on the departmental system of persal.
Requests for Assistance
Honorable Whip, I am deeply concerned that my grievances are have been ignored due to my title and socioeconomic status as a woman and someone without substantial resources. The Department 's actions or lack thereof, highlight a disregard for the principles of Justice and equity they are meant to uphold.
I kindly request your urgent intervention to:
1. Hold the employer accountable for Non-compliance with labor and occupational health laws.
2. Ensure the proper and fair resolution of my CCMA and GPSSBC cases without further delays.
3. Investigate the workplace abuse, bullying and retaliation I have endured, including the mishandling of my medical condition and Z1(a) process.
4. Protect whistle blowers like myself who face retaliation for reporting corruption and abuse of power.
Conclusion
I have exhausted all internal and legal avenues to me, yet my employer continues to disregard their obligations under the law. Workplace abuse is a form of discrimination, and it's impact cannot overstated. It is my hope your office can intervene to uphold Justice and ensure that my rights, as well as the rights of other employees in similar situations are respected and protected.
