Dear Minister Patel,

I am writing to you because I tried reaching out to MIOSA however they failed me. I bought a car at Audi Rustenburg super group, with the impression that it was a brand new car / demo car because it was on the floor/ showroom at the dealership when I viewed it. As a second buyer I didn't know that the quote is not the OTP to me it was the same only realized later when I asked about the OTP. I was sold a pre-owned /used car with 2000km which I was not aware and impulsively signed the invoice without reading through it and only realized it later after I have left the dealership. While in the process of resolving that I received an email on 26 June from Audi SA indicating that the lock nuts fitted to the rear axle might not have met the specification. The same day I emailed Ausi SA and Audi Rustenburg to book in the car on 28 June to have a look on it because I have been hearing sounds and it was a risk for me. The salesman never responded to my email, I only received an auto reply from Audi SA and they also called me on Monday 28 June. They indicated that the part will be arriving in the country on 7 July and not to worry I must just not drive above 120 or at a high speed. They also advise me that should the car pull to the side I must call Audi road assist. Unfortunately on 29 June 2021, when I was on my way to work travelling from Rustenburg to Glenharvie( Western area) along R24 road in Herkport the car pulled to the side and drove into the gravel road, I was about to hit a poll and as I tried to pull it back to the tire road, the car after seeing what has happen he tried to overtake me and we bumped each other and both cars lost control and started spinning. I managed to engage the breaks by God's grace it stopped. The other car stopped in the veld and next to the ditch. I then called Audi road assist and the gentleman by the name of Marius assisted me and advise me not to call the insurance, and that they will provide me with the towing, courtesy and family car from the accident scene back to Rustenburg. My elder daughter advised me to call the insurance company because I was involved in an accident with another car . I did that and the insurance lady also spoke to the gentleman I was involved with in an accident. The car was towed to Audi Rustenburg and we were also driven to Audi Rustenburg. Minister I was in a state of shock, disillusioned and having a horrible headache. On arrival the workshop manager was so abrasive and no one even cared to ask how I was and what has happened. I was later told that they wont be provided with the courtesy car and I asked the ladies who worked at the workshop to arrange a lift for me to the doctor. The sales man who sold me the car was asked to take me. I then asked him to first take me home so i can drop off my laptop and other things which were in the car. I was later told by Audi SA that they will also note provide me with the courtesy car while the investigation is still underway. A friend referred me to MIOSA which I did, however the case manager concluded the report without the documents that I was requested to send, through( emails, contract, invoices and OTP)it favoured the dealership and Audi SA. Minister kindly note that for the past four months I have been paying for the car instalment and insurance for the car that is sitting at Audi Rustenburg. Whenever I asked questions to Audi Rustenburg its director Willem will respond by saying they are only responding to MIOSA. Not sure it is because I am black and a nobody. However Shawn the workshop manager sent his PA Pretty to call me and informed me to collect my car, and that from 28 September they will be charging me R500.00 for storage. Minister after 27 years of democracy blacks life's and livelihood don't matter. I use public transport and bolt to go to work. I am a mother of three and a single working mother. I don't have any family members in the North West to assist me with transport. I haven't gone home for the past four months because I don't have a car. During campaigns the president and other government officials were saying we must reach out to government whenever we need help. That's what I am doing now with the hope that I could get justice with my problem. I have paid R 3 500.00 to CNN in order to appeal my case. My question minister is this the South Africa we envisaged whose state organs are captured and only benefitting the haves and overlooking the plight of the poor. I am now told by Mt Odendaal I must repair my car, which the accident was not intentionally caused by me. Minister if I knew that the car had 2000 km on the clock I would have requested the service book and the 80 point check record which were both not provided to me. What if the first buyer returned it to the dealership because it was having some mechanical faults which I am not aware of. I am hoping that this message to you wont be a fruitless one and will yield some results.

The contents of your e-mail are noted. Kindly complete the NCC complaint form attached and return it to and attach all supporting documents including the closing letter received from MIOSA so that we can assess it and advise accordingly.
