I therefore suggest that a new statutory crime aimed at convicting and punishing deliberate and negligent peacetime actions that harm the State and country by citizens and non-citizen civilians/officials alike be created to cover the behaviours mentioned above. The combination of impact on state and citizenry constituting the gravity of these crimes so that perpetrators can be punished harshly.
I propose creation of a new statutory crime to address and punish deliberate and negligent peacetime actions that harm the State and the country, committed by both citizens and non-citizen civilians or officials. This crime should encompass the behaviors mentioned above, with the severity of the offense determined by the impact on the state and its citizens, allowing for harsh penalties for the perpetrators.
The problem with a crime on the books is that it is meaningless unless promptly and effectively prosecuted and convicted. That is why failures by law enforcement agencies and prosecution authorities should also be subject to this crime. Law enforcement must realize that it will need to step up to save our country. Civil servants, policemen, prosecutors and others owe the public their employment and should exhibit good faith of the highest order. Failure to do so by officials is unforgiveable and deserves a way higher level of punishment and shame for which this crime should cater.
A crime on the books is meaningless unless it is promptly and effectively prosecuted and convicted. Failures by law enforcement agencies and prosecution authorities should also fall under this new crime. Law enforcement must recognize that they have a critical role to play in safeguarding our country. Officials owe their positions to the public and should act in good faith at the highest standard. Failure to uphold these duties is unforgivable and should be met with significantly harsher punishment and public disgrace, for which this crime should provide a framework.
I do not know how Constitutional it may be, but this crime should:
• Keep the burden of proof on the prosecution as low as possible – perhaps through presumptions.
• Institute the highest level of punishment bar the death penalty – life sentences.
• Sentences to not be made possible to run concurrently or be subject to commuting or release on parole because of their gravity and impact on and threat to society.
• A shame list website should be created where the public can see who had been convicted.
