In August 2023 I purchased a vehicle from Westvaal Welkom. It quickly turned out that the vehicle had major faults. I approached the dealership to have it repaired they did not do much. Eventually I insisted that I take the vehicle to Toyota who identified the problems and quoted to have it repaired.

The dealership refused on the grounds that they believe it to be uneconomical to repair the vehicle. The dealership wanted to refund me which I refused as is my right under the CPA.

I lodged a case with MIOSA. After lodging the case with MIOSA I found another problem which indicated that the vehicle received major damage in and accident and not repaired correctly. There is no way that vehicle was roadworthy.

I sent this evidence to MIOSA but they seemed to ignore it and found in favor of the dealership.

I then lodged a case with the NCC but I could not get any replies or correspondence out of them without a HUGE struggle. Eventually I had to ask the Public Protector for help in getting information. Now they have also found in favor of the dealership, ostensibly ignoring the evidence.

Could I possibly impose on you to look at this case. The dealership has contravened the both section 55 (selling and accident damaged, unroadworthy vehicle) and 56 (refusing to remedy according to the direction of the consumer) of the CPA. I feel like I am being thrown to the wolves by the agencies who are supposed to protect us consumers.
