- Labour Complaints Against Samancor Western Chrome Mine

The following is an illustration of the serious labour complaints that we have against Samancor Western Chrome Mine ( Rusternburg ):
1. The re - appointment of HR Manager into her former position after she had resigned without following proper recruitment procedures and policy for recruitment and appointment of employee.
2. The CCMA Senior Commissioner assigned to facilitate the last Section 189 in 2020 for Samncor was very biased and compromised . This is the same commissioner who facilitated previous Samancor Sections 189 in 2012 , 2016 and 2020 . Effforts to have the commissioner recuse himself based on the fact that he was compromised and biased towards the company were undermined by both Samancor Management and Organised Labour hence heavily disdavantaging common employees .
3. The DMR inspector who was involved in negotiations to re-open the mine after the first lock down , Mr. Raymond Sebetloane , was appointed again without following proper recruitment procedures and policies. This clearly shows why he was ignoring safety short falls not implemented by the company before allowing them to re-open. He was totally biased in favour of the company re-opening at the expense of the Safety and Health of poor workers .
his was rewarded by the company by being appointed . Currently he is busy assisting the company to ignore Serious Health and Safety Matters through his connections , for example ,
not all employees were tested for COVID- 19 virus to be declared fit to resume work after December Break. Furthermore , no statistics was presented to employees and organized labour to indicate the total number of employees tested , infected , dead . All is manipulation influenced by the DMR Inspector who is very connected .
, falsely retrenched and been replaced by White Counter parts who are less experienced and qualified but are connected to the General Manager.
4. Contract employees who are working for companies owned by the General Manager and his White MANCON and Black associates who are also former managers are now employed to do the same kind of work / Jobs that were done by employees who were retrenched in May 2020, some employees who were retrenched have been recalled barely a month after but being paid half what they were initially earning before being retrenched. Deliberately done to steal from poor employees without any recall agreement.
5. The 11 hour Shift from 6am to 5 pm was firstly signed without full mandate of all employees , especially those that are scared of joining any Union. The agreement signed requires that all employees access equal benefits but those employees recalled after section 189 in 2020 are being excluded from these benefits even though they are entitled to as former employees and as per agreement signed.
6. The current HR Manager , Miss Anele Janse Van Rensburg is ill treating black employees and awarding unnecessary benefits and favors to white employees and union officials , for Almost all Union Officials do not report to their respective work places or duties . Implying that they are management watch dogs but not there to serve the interest of poor employees.
7.The current Unions - NUM and UASA must be investigated as they are part and parcel of this corruption circle which is stealing from poor employees. For example some Union Shop Stewards who do not qualify to access Company accomodation are currently bribed and occupying company houses without following proper housing procedures and policies of the company. For Instance Rikhotso Martin, Mabaso Shadrack ,Lefu Soke and Segwagwe Lawrence.
8 . Rustenburg DMR and CCMA must also be investigated as they are the custodians of the constitution.CCMA is conniving by assisting illegally fired employees to lose their cases there , a clear sign that there is exchange of bribes.DMR is busy disclosing all employees who report cases to them against Samancor , and then the company facilitates dismissals that get confirmed at CCMA.
