Good day Im renting a house which the owners claim they were busy with their divorce as from 2021 up until October 2023.Around about May 2021 my mother approached ST asking her will she sell the house because we were looking for a house to buy. She told my mom she will because she and WV are busy with their divorce and she dont want anything to do with the house. At that time both S and W was not living in the house. Including their children. W would sleep in the house now and then if the neighbors complain to him that the house was broken into. On the 16th July 2022 my husband and I meet up with S at a funeral of a mutual friend. We both approached her as to the selling of the house she then told us yes she will sell it to us but we have to speak with W. December 2022 my husband spoke with W he said he will sell but for r200 000. My husband told him its to much for a one bedroom house with two illegal structures attacked to it and with no electricity and broken toilet. 15th December 2022 I contacted S again I asked her to rent the place to us, she told me she have nothing to do with the house we need to speak with W. At that time she was living on a farm for longer than 6 months. On the 26th March 2023 we approached W, he agreed to rent the place for r1000 until he restore the electricity and we can rent the house for a year. 10th April 2023 my husband went to Wilem for the keys. He gave my husband a story that someone else have paid him r2000 and they have the key of the house. I told him that if he want the advance money and more for rent he must tell us and not to make up stories. He gave the key. We moved in the 11th April 2023 and paid the advance. We told him a lease need to be drawen up, he said we must go to the police stay for the lease. We told him a lawyer does it or we can do it ourself but he didn't wasted to hear any of it. On the 29th April 2023 we contacted him to meet us at the police station. The police officer told him they don't do it. In the police station we paid him again r1500 for the rent. 26 April 2023 we had the electrity box installed out of our own pocket. 3rd May 2023 W came to my to tell me he is going to have a lady put up a place on the yard. I told to come speak with my husband regarding it. He came on the 4th May 2023. The only thing that he told my husband was we can live in the house for six months. He was angry because the gate stays locked and he had to wait for us to open it. 7th May 2023 he came with the lady and showed her the yard. She didn't move in immediately but 3 weeks later. 10th May 2023 my husband told me S approached him telling him we are cashing out to W but when are we paying her? I told my husband when he see her again she must make a turn by the house. 14th May 2023 S came that's when she said her daughter told her we living in the place. She said that the judge said W must move out and she must move back home. W have no rights over the house. She told me as from end May 2023 we must pay her and the rent is to much that we paying W. She said that she's not interested in moving back and neither will she put us out. I asked will she sell the place she again said yes. I told her can we meet with her because my husband was not at home. On the 16th May 2023 my husband and I went to S, we spoke about the selling of the house she said that she's waiting for my mom. I then assured her that my mom was asking on our behalf. We offered her r90 000. She agreed. I asked her about the lady on the yard. I told her that she have not moved in yet. S told us we must tell her we are busy buying the place and we dont people on the yard. 26 May 2023 I told the lady she must speak with Sarie because we going to buy the house. S told the lady that we must give her electricity and she can stay until the divorce is finalized then she will get back to her. I spoke with S again she told me no she's still selling the house to us we must fix what must be fixed and pay the rent then what is left from the rent money we must pay her. 24 June 2023 W came to the house, he was standing outside of the property. My mother in law asked him for a piece of one of his plants. He told her he have nothing to do with the house, it's my house i will give her. She asked him again and he answered her in the same way. He was of sound mind at that point. 29th July 2023 my husband and I went to Malmesbury our daughters aged 17,16 and 7 was at home because they wanted to prepare themselves for exams and church. When ever we leave the house we lock the gate that morning we did the same. I want to speak with you regarding this problem I have approached the ward councillors. I am tired of hearing its a private matter between landlord and tenant. I feel I have no rights as a legal south africa please allow me to give you the full story.
