am flabbergasted at the turn of events and the conduct and disposition of the SAPS officials. 

 

I would like to thank Colonel Joe Moodley from the Dundee Command Cluster for engaging with us professionally and completing his investigation. However, we are utterly disgusted at the shameful behaviour of SAPS Officials in which they engage, communicate, body language and tone towards civilians.

 

Allow me to highlight the sequence of events under observation since officially lodging a complaint.

 

The Investigating Officer Ngwenya has displayed unsympathetic characteristics and has been more supportive to the perpetrator. 

 

It's absolutely appalling as an abiding citizen of this country and a member of this society that in such a small town such as Dundee we have to witness such despicable acts of corruption and bribery.

 

Colonel Joe Moodley has been very tip-lipped in his investigation and in the approach and who he has approached in this investigation. He has indictated that we have been interviewed together with the investigating officers and Constable Bezuidenhout. This brings me to how did the perpetrator become aware that a complaint at the Dundee Cluster Command has been investigated into and right after the I.O Ngwenya was interviewed? I have provided Colonel Joe Moodley proof of this statement and at that point Bezuidenhout was never interviewed.

 

A complaint with EDTEA KZN ( Consumer Complaints) had been lodged against KS Pillay dated 25 February 2022 and an official complaint form signed and completed had been sent for their attention on the 28th February 2022. They have given Mr KS Pillay until 9th March 2022 to respond. 

 

To our abhorrence the response from KS Pillay was a fraudulently signed document named "Voluntary Surrender Form" dated the very same date as the purchase date of the vehicle. A case has been opened dated 10 March 2022 with the case no: 106/3/2022. It's logic to believe that this is fraud because who signs a Voluntary Surrender Form on the date of purchase. There are other factors besides it not being Miss AK Aku's signature which proves that this was created after he became knowledgeable about the charge and complaint against him. I wish to place on record that it is the 5th April 2022 and no feedback on the case for fraud on the signatures has been provided.

 

On the 30th March 2022, Colonel Tooray from the Hijacking and Theft of Vehicles Unit from Newcastle made contact with our attorney advising him that the vehicle would be returned to AK Aku and she is required to make her appearance at the Dundee SAPS to collect and sign for the vehicle. He further advised that pictures and findings of the vehicle must be documented.

 

On the 31st March 2022, I.O Ngwenya was present to handover the vehicle but was in a great haste and mentioned he is in a rush to attend to a court matter. He had the papers signed and was off before an inspection on the vehicle was conducted. A certified mechanic and electrician was on scene to inspect the vehicle. The vehicle could not be "started" and boosting the vehicle had also failed. It came to light that it was evident that the vehicle had been tampered with. It was not long before KS Pillay made his appearance with arrogance, with a so called Mr Desiga Padayachee who is employed at Mohamed Abdulla Attorney's in Dundee together with the I.O Ngwenya.

 

The I.O was as usual rude in his tone and body language and advised that the decision has been over turned by the state's Attorney / Advocate Stander without any further explanation. We went on to question the I.O about the money and watch that was in the vehicle in which he responded in Zulu " Aay you people are coming with more stories", in an arrogant tone, yet on the day of opening the case, it was documented in the statement as well as his interview with us after the vehicle was stolen. Is this not evidence that he did not conduct an ethical and an insightful investigation? In the very same moment I.O Ngwenya winked at KS Pillay, showed him a "sharp sign" and just said Pillay! We witnessed this with our naked eye! Only hours later it became knowledgeable that the decision was overturned by Attorney/Advocate Stander based on the "fraudulent document produced as "Voluntary Surrender Form". How was it that the vehicle was driven by KS Pillay to his garage moments later yet the vehicle was unable to start while we were there? Was this a ploy in stalling us while they waited for the decision to be overturned?  I.O Ngwenya was in a great hurry yet returnes moments later to assist KS Pillay, was his haste was to attend to KS Pillay ensuring that the decision was overturned? 
I.O Ngwenya needs to be thoroughly investigated and interviewing and taking down a statement from this unethical and corrupt SAPS Official is not sufficient. Draw his telephonic records, his location and what was his association with the perpetrator.
