I write this email with utter disgust and disbelief that we live in such a lawless land, that the victims are treated as criminals and the criminals are given priority. Nevertheless, I am Dhanesheri Sayed a resident in Dundee KZN and would like to request an investigation into the reasons as to why the prosecutor has failed to prosecute the perpetrator. The dealer known as Corner Service Station at 33 Victoria Street, Dundee. The owner is known to us and unfortunately a family member. Irrespective of any relation, he has committed a crime hence he needs to face the consequences of such. He is also an ex reservist for the Dundee SAPS hence he has been granted "special favours". The fact that he has instructed the SAPS not to open a charge gives us enough reason to believe so.
My sister, Aaqelah Kassim Aku has fallen victim to unlawful practice. She purchased a vehicle with the description 2017 Chev Utility, Registration Number: NDE 21882 and signed and took delivery on the 09/02/2021. She commenced her payments diligently monthly as per the agreement.
Late afternoon (approximately 6PM) on the 22nd February 2022, my 67 year old mum drove the vehicle to a street name Mcphail Drive, to complete her routine afternoon walks. Upon her return she noticed the vehicle with a few of her belongings inside had been stolen, with the keys still in her hands. A jogger by assisted in making contact with my sister who then fetched my elderly mum. They proceeded to the local Dundee Police Station to open a charge of theft and was at that point met with Sergeant Bezuidenhout who advised the owner of Corner Service Station called and advise not to open a case because he "took" the vehicle due to non payment!
On what grounds did this police officer take instruction from KS Pillay and without proof? Why was KS Pillay so comfortable and felt that he can dictate to the local police station? Who received the call from KS PILLAY, AT WHAT TIME AND ON WHAT BASIS WAS THE INSTRUCTION RECEIVED AND ACTIONED? We have a right to these answers!!!!Which dealership retains a key and then goes and steals it when its in a public space? There is a vast difference between THEFT and REPOSSESSION! Further to this there are protocols as a credit provider in which you need to follow and obtain before repossession.
In the interim my Uncle Mr MS Pillay was travelling in the vicinity of Old Acre Street in Dundee and had seen the vehicle being driven by owner of Corner Service Stations son, Mr Yugen Pillay. Mr MS Pillay also has a tracking facility and his report is evident in his location to the location of the vehicle stolen! The owner of Corner Service Station only realized that the son had been seen and needed to contact the local SAPS to attempt to not have a charge brought against him.
We were thereafter assisted by Captain Ngwenya who advised we have a right to open a case.
We also immediately made contact with our tracking service provider to notify them that the vehicle has been stolen. After a few minutes NETSTAR has advised that the vehicle is NOT STOLEN but REPOSSESSED without any proof of this statement by the owner KS Pillay of Corner Service Station. This business / owner has contravened the act! This business is neither registered with the FSB or NCR! It is appalling to place on record that the SAPS Vehicle Theft Unit is actually negotiating and are in discussion with a criminal! There is no justification or a reason for theft . You have committed a crime and like any other citizen face the consequences.
Mr KS Pillay placed on record with Netstar that he had obtained " a court order" hence he has the right to the vehicle and denied them access to his property or to have pictures taken.
On the 23rd of February 2022 the vehicle was impounded from Fris Street, Dundee which is the residence of Mr KS Pillay.
After seeing the prosecutor, Ms Sithole last Thursday, she gave us the indication that she will only look at the file next week and will give my mum a call. However, to our surprise she called my mum, Friday morning 4th March 2022 and says that its a civil matter and it can be resolved. She further made mention that its difficult to prove their intention. Her tone and in the manner in which she addressed my mum as the complainant was in a dissatisfying manner.
Honestly, this response doesn't sit well with me at all. Mum has informed her that she is dissatisfied with this decision and Ms Sithole thereafter advised she will hand the file to the Senior Prosecutor but in an abrupt tone and didn't wish to hear anything further.
This morning my mum was contacted by I.O Ngwenya to advise the prosecutor has declined to prosecute.
We would like this matter investigated as we feel, the I.O's as well as the Prosecutor have failed to look at the facts of this matter!
