Section 28 of BCEA exclude employers employing less than 5 employees from keeping records such as required in terms of section 33 of the BCEA. Yet in terms of 4(7) of National Minimum Wage bill says that section 32 and 33 of BCEA applies for the purpose of national minimum I think that this is gonna cause a problem for inspectorate when section 28 of BCEA is read together with section 4(7) of the national minimum wage bill. It should have been better to amend section 28 or to make it clear by adding the words "despite section 28 of BCEA" to section 4(7) of the national minimum wage bill. Ithink that these records are important to prove that the employer complies and should have been clarified in act to avoid intepretation issues
